1. Acceptance of Terms

By accessing or using Talon (“the Service”), operated at heytalon.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Talon provides a platform for deploying and managing personal AI assistant instances accessible via Telegram, Discord, SMS, and WhatsApp. The Service includes AI-powered conversational capabilities, plugin integrations, and messaging infrastructure.

3. Accounts and Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person may not maintain more than one account.

4. Subscriptions and Payments

  • Access to the Service requires a paid subscription (Starter or Plus tier).
  • Subscriptions are billed monthly via Stripe. Prices are listed on our pricing page.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' advance notice.
  • Refunds are handled on a case-by-case basis. Contact [email protected] for refund requests.

5. SMS Messaging Terms

If you opt in to the SMS channel:

  • You consent to receive AI-generated SMS messages from your Talon assistant at the phone number you provide.
  • Message frequency varies based on your usage of the Service.
  • Standard message and data rates may apply depending on your mobile carrier.
  • You may opt out at any time by replying STOP to any message from your assistant.
  • Reply HELP to any message for assistance information.
  • SMS is available for US phone numbers only.

6. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk commercial messages
  • Harass, threaten, or abuse others
  • Generate or distribute illegal, harmful, or objectionable content
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Interfere with or disrupt the Service or its servers
  • Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

7. AI-Generated Content

  • Responses generated by your AI assistant are produced by third-party AI models and may not always be accurate, complete, or appropriate.
  • You are responsible for reviewing and verifying any information provided by the AI before acting on it.
  • Talon is not liable for decisions made based on AI-generated content.
  • AI-generated content should not be relied upon for medical, legal, financial, or other professional advice.

8. Intellectual Property

The Talon name, logo, and platform are the property of Talon. You retain ownership of any content you provide to the Service. By using the Service, you grant us a limited license to process your content as necessary to operate the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Talon and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages that temporarily affect availability. We are not liable for any downtime or service interruptions.

11. Termination

You may terminate your account at any time through the dashboard settings. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the updated terms.
